POST AND PACKING

• POST AND PACKING WITHIN THE UK (Shipping)

UK Post and Packing is charged at variable rates based on package dimension and weight. We use Royal Mail - First Class and ParcelForce - Express 48 services wherever and whenever possible. All orders are subject to a minimum charge of £3.70 plus VAT.

• EXPORT ORDERS (Overseas Shipping)

We export around the world and delivery to all overseas destinations including the Republic of Ireland and other EU countries will be charged according to weight and package dimension with a minimum charge of £4.00

The prices quoted at checkout are based on overall weight and dimension of shipping package. There will be situations where orders will not meet our couriers package specification (these vary by destination country) and/or are to be delivered to remote locations. In these circumstances we reserve the right to request additional payment or cancel the order and return payment to customer.

www.christiebears.co.uk is owned and managed by Christie Bears Limited, a Company registered in the United Kingdom and subject to the Laws of England and Wales

The following terms and conditions apply to all transactions on www.christiebears.co.uk. By placing an order on this website you are entering an agreement with Christie Bears Limited that incorporates these terms and conditions. Please read them carefully and print a copy for future reference. These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.


Description of Goods/Warranty and Liability

Although we warrant that the goods will, at the time of delivery, correspond to the description given by us, it is not practical to publish detailed specifications of all the products. All images, descriptive matter, specifications and advertising are for the sole purpose of giving an approximate description of the goods.

If you buy goods that have no published technical specifications, it is your responsibility to establish the suitability of the goods for your intended purpose.

Typographical Errors

In the event that a product is listed at an incorrect price due to error, we shall have the right to refuse or cancel any orders based on the incorrect price whether or not the order has been confirmed.

Product Images / Specifications

We endeavour to ensure that all images and specifications are correct at the time of publication, however, they may vary. We can therefore accept no responsibility for incorrect images and/or information. If however you find a mistake with an image or product specification please notify us.

Payment Method

Whilst this is a UK site we do accept orders from most countries in the world. Payment will be taken only in British Pounds (Sterling). On the order you must provide us with the exact address and telephone number that your credit card issuer has on file for you. Your order will only be processed once authorization of your credit card has been properly received.

Availability of Goods

All products are subject to availability and may be withdrawn at any time. However it is our policy to contact you if a product is out of stock. If you subsequently do not wish to proceed with the order or for any reason we cannot supply the product we will arrange for the order to be cancelled.


Special Orders

We offer an extended range of products that are obtained directly from our suppliers. These products are subject to suppliers' stock availability and delivery dates made by the suppliers' own delivery services. It is our policy to contact you to explain the stock and delivery situation with these products. If you do not wish to proceed with the order, we will arrange for it to be cancelled.

Once the order has been agreed cancellations or refunds will not be acceptable on these items. You will be charged upon placing your order and we will notify you of the estimated delivery date.

Delivery

We endeavour to attain fast and efficient delivery, but we make no binding commitment to meet performance objectives.

Where customers have requested and paid for a specified delivery time, and this has not been met, only the additional delivery charge will be refunded not the full amount.

Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence. We shall not be liable for any losses, costs, damages or expenses incurred by the customer, or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.

Unless otherwise agreed we may deliver by instalments

Delivery of the Goods shall be made to the Customer's address and the Customer shall make all arrangements necessary to take delivery of the Goods whenever they arrive.

Time Limitations for Notification of ‘Damaged in Transit Claims’


Should any damage be identified on opening the package you must notify us of such damage within 48 hours of receipt. As soon as we receive the damaged items back, replacements will be sent out and you will be reimbursed for the cost of returning the damaged items to us.


Shortages

You must notify us of any shortages within 48 hours of delivery. As far as we are able, we will make good the shortage otherwise we will reimburse you the cost of the shortage


Incorrect Goods

You must notify us of any incorrect goods supplied within 48 hours of delivery. If the items are not as ordered, you must not damage any manufacturers packaging or use the items. As far as we are able, we will exchange the items, otherwise we will reimburse you the cost of the returned items. In both instances we will reimburse you the cost of returning the items to us.


Non-Deliveries

We will not accept liability for goods lost in transit unless you notify us of non-receipt within a reasonable period of time i.e. no more than 14 days from placement of UK and Eire orders and 30 days for overseas orders.


Cancellation of Orders and ‘Cooling Off Period’

At Christie Bears we want you to be delighted every time you shop with us. Occasionally though, we know you may want to return items. That is why, if for any reason you are unhappy with your purchase, you can return it to us in its original condition within 14 days of the date you received the item. This is in addition to the provisions of ‘The Consumer Protection (Distance Selling) Regulations 2000’ which provide our customers with a cooling-off period together with the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. This applies to all of our products except Special Orders (see above).

To cancel your purchase within the fourteen-working-day cooling-off period, you must notify us within those fourteen days, in writing, fax or email detailing the item(s) concerned and your intention to return them to us. Please package the relevant item(s) securely and send it to us so that we receive it within fourteen working days of the day after the date that the item was delivered to you.

For your protection, we recommend that you use a recorded-delivery service if the value of the return is more than £50.00 Sterling.

Please note that you will be responsible for the costs of returning the items to us unless we delivered them to you in error, or if the item(s) is/are damaged or defective.

As soon as we receive the item(s) back we will refund the relevant part of the purchase price for that item within 30 days of your notification. You may need to produce proof of purchase so please keep your Sales Receipt.

Refunds

If for any reason you are issued with a refund, please note the following,

All refunds will be issued using the same payment method as on the original order.
When a refund is processed, you will receive appropriate documentation.
A refund will usually reach your credit card account within 4/5 working days after it has been processed, however please allow up to 10 working days for it to be credited before contacting us.

Liability

Except as may be implied by law and except in the case of death or personal injury where the Customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by Christie Bears Limited, the remedies to the Customer shall be limited to actual damages which shall in no circumstances exceed the value of the Goods involved. Christie Bears Limited will not be liable for any indirect, incidental or consequential damages

Force Majeure

Christie Bears Limited will not be liable whatsoever for any failure to meet its obligations under these Terms and Conditions by any reason or cause beyond its control.

No Waiver

Christie Bears Limited’s failure to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.

Severability

In the event that any or any part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

General

From time to time Christie Bears Limited may change, alter or modify these Terms and Conditions. Any change to these Terms and Conditions will be posted on the website www.christiebears.co.uk, and any use of the website by the Customer after such change has been posted will be deemed to indicate the Customer’s agreement to the modified Terms and Conditions. If the Customer does not agree with the modified Terms and Conditions he/she should not use the website.



Only Christie Bears Limited may freely assign its rights and/or obligations under any Agreement incorporating these Terms and Conditions



The Registered Office of Christie Bears is located in Boverton, Wales. All legal issues arising from or relating to the use of the website www.christiebears.co.uk shall be construed in accordance with and determined by the Laws of England and Wales



All parties to any Agreement incorporating these Terms and Conditions accept and irrevocably submit to the exclusive jurisdiction of the Courts of Law in England and Wales


Privacy Policy Data collected by this site is used to:
a. Take and fulfill customer orders
b. Administer and enhance the site and service
c. Issue a unique identifier (e.g. customer login)
d. Monitor customer account status beyond that required for individual purchases
e. Only disclose information to third-parties for goods delivery purposes
